1. Agreement to Terms

By accessing or using the Penjo Studios Studio Management & Website CRM ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not access or use the platform.

2. Service Description

The Service is a private website management and CRM platform built for Penjo Studios. It enables authorized users to manage website content, publish blog articles, upload and manage photo and video assets, monitor website analytics, and manage client enquiries from a secure unified dashboard.

3. Subscription & Billing

Access to the Service is provided on a recurring monthly subscription basis at the rate of CAD $49 / month. Subscription fees are billed in advance on each monthly renewal date. Payment processing, order fulfillment, and invoicing are securely conducted by our authorized Merchant of Record, Paddle. You authorize recurring billing to your selected payment method until your subscription is cancelled.

4. Account Access & Security

Access is private and restricted to authorized clients. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your login. You agree to notify Penjo Studios immediately of any unauthorized access or breach of security.

5. Acceptable Use

You agree to use the Service exclusively for lawful studio management and website operations. You must not attempt to reverse engineer, decompile, tamper with, probe security vulnerabilities, or interfere with the proper functioning of the software or infrastructure.

6. Intellectual Property

Penjo Studios retains all rights, title, and interest in the CRM platform software, user interface design, code, and systems. All content, photography, video assets, blog articles, and client information uploaded or published by the subscriber remain the intellectual property of the subscriber/creator.

7. Service Availability & Maintenance

We strive to maintain continuous service availability and performance. Periodic system updates, maintenance, or infrastructure improvements may be scheduled, with reasonable commercial efforts made to minimize disruption.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Penjo Studios and its service providers shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of or inability to use the Service. In all cases, aggregate liability is strictly limited to the subscription fees paid by you in the one (1) month immediately preceding the event.

9. Cancellation & Termination

You may cancel your subscription at any time. We reserve the right to suspend or terminate account access in the event of a material breach of these Terms or non-payment of subscription fees.

4. Payment Processing & Third Parties

All subscription billing transactions are handled by our Merchant of Record, Paddle. We do not store or process credit card numbers or sensitive banking details on our servers. Paddle processes payments in accordance with their privacy standards.

We use trusted cloud infrastructure and storage providers (such as Supabase and Hostinger) solely to securely host and store application data and media files.

5. Data Storage & Protection

We implement industry-standard administrative, physical, and technical safeguards, including SSL/TLS encrypted transmission and secure authentication protocols, to protect your data from unauthorized access or disclosure.

6. Data Retention

We retain your account data and managed content for as long as your subscription remains active or as required to meet operational, tax, or legal requirements.

2. How to Cancel

You can cancel your subscription at any time without fees, penalties, or questions asked. To cancel your subscription, you can:

• Email support directly at info@penjostudios.com or info@penjostudios.com with your account email.
• Click the subscription management link provided in your Paddle payment email receipts.

3. Cancellation Timing & Access

Upon cancellation, your subscription remains active until the end of your current monthly billing period. You will continue to have complete access to the CRM, website management features, and media assets throughout that prepaid period. No further recurring charges will occur after cancellation.

4. Refund Policy

Because access to cloud storage, hosting capacity, and CRM tools is provisioned immediately upon subscription activation, monthly subscription fees are generally non-refundable once the billing period has started.

Billing Discrepancies & Service Issues: If you experience billing errors, duplicate charges, or verified service disruptions that prevented platform usage, please contact us at info@penjostudios.com within 14 days of the transaction. We will promptly review and refund verified claims in accordance with Paddle's buyer terms.
